San Diego DUI Sentence for Vincent Jackson Includes Work-Release Program

San Diego Chargers Vincent Jackson's sentencing will include four days in a work release program but no jail time after he pled guilty to his second San Diego DUI charge.

Vincent Jackson who is likely to be suspended by the NFL a couple of games was also sentenced to five years probation. He was also ordered to 15 days of community service from his January 2009 San Diego DUI charge, and pay a fine of $2048.

According Judge David Danielson, he said he would treat Jackson’s San Diego DUI case no different than anyone else with a second charge for driving under the influence. “I’m sure once it’s all said and done, we’ll definitely get the last laugh and hopefully our law enforcement will definitely continue to support us in the way that they have,” said Jackson in an interview.

The San Diego Chargers Pro Bowl wide receiver’s blood alcohol content was twice the legal limit in California measuring 0.17. According to his San Diego DUI lawyer, Jackson’s sentencing is standard for a second DUI offense.

San Diego Former TV Anchorwoman Arrested for Suspected DUI

Former San Diego anchorwoman Allison Ross was taken into custody on suspicion of driving under the influence after taking a field sobriety test, according to San Diego police.

Ross, 55, who worked as an anchorwoman from 1978 to 1989 at KFMB-TV, appeared to be driving while intoxicated on the wrong side of the road when a San Diego police officer saw her heading toward him just before 4:00 a.m. on Sunday in the 7600 block of Fay Avenue. The officer had to move out of the way to avoid being hit.

The suspected DUI driver was pulled over on Kline Street by the officer who then administered a field sobriety test. Ross was arrested on misdemeanor DUI and taken to Santee’s Las Colinas Jail for women where bail was set at $2500.

Ross who also worked in radio is facing charges for misdemeanor DUI and is scheduled to appear in court on Wednesday.

DUI Charges For University of Florida Defensive Lineman

DUI charges filed against a University of Florida defensive lineman after officers found him asleep at the wheel and suspected him of DUI.

Carlos Dunlap was arrested early Tuesday morning after a police officer found the 20 year-old defensive lineman asleep in his car at a stop light. The officer had been responding to a report of reckless driving. The red 2000 Chrysler that Dunlap was driving didn’t move after several signals had changed, that’s when the officer found the suspected DUI driver asleep, according to Gainsville police Lt. Keith Kameg.

About 3:25 a.m. police officer Robert Rogers arrested Dunlap for driving under the influence after he appeared to be to some extent incoherent and unbalanced on his feet after performing field sobriety tests. Dunlap was also reported to smell of alcohol and he refused a breathalyzer test.

Dunlap was taken to Alachua County jail on suspicion of driving under the influence. Last year the defensive lineman was named the most outstanding player in the BCS title game. Florida coach Urban Meyer has suspended the 290 pound, 6 foot 6 athlete from playing in Saturday’s SEC Championship Game. “He’s not going to play,” Meyers said.

Senator John Kerry’s Daughter Alexandra Arrested for DUI

Senator John Kerry’s daughter Alexandra was arrested in Los Angeles early Thursday morning for driving under the influence, but was later released after a breathalyzer test indicated she was under the legal limit.

Film producer and director 36 year-old Alexandra Kerry was stopped by Los Angeles Police for driving on an expired registration. She was then taken into custody for probable DUI and later released on bond.

“Alexandra Kerry was pulled over for an expired registration and was released after the results of a breathalyzer test at the police station were under the legal limit, said democratic spokeswomen Jodi Seth.

NASCAR Driver AJ Allmendinger Arrested On Drunk Driving Charges

AJ Allmendinger was arrested for DUI after being stopped by police early Thursday morning and failing a field sobriety test, according to Mooresville police.

The NASCAR placed driver said he make a mistake driving while intoxicated after having dinner and drinks on Wednesday. “I honestly felt fine, but I obviously should have erred more on the side of caution, particularly given what I do for a living,” said Allmendinger. “It was a bad judgment call,” he said.

The DUI driver will have his license suspended for 30 days after being given a breathalyzer test that indicated he was 0.08. According to North Carolina law it is an automatic license suspension. NASCAR placed the suspected drunk driver on probation until the end of the year.

“Hills” Reality Show Star Stephanie Pratt Arrested for Driving Under The Influence

MTV reality star Stephanie Pratt of the “Hills” was taken into custody for suspected DUI after attending castmates birthday bash at a nightclub.

The suspected DUI star was arrested on Sunday about 3:45 a.m. after blowing a .08 and .09 after taking two breathalyzer tests. The California legal limit is a .08. Pratt had just attended a birthday celebration at “Empire” a nightclub in Hollywood for Holly Montag.

Pratt was taken into custody on suspicion of driving while intoxicated. She was released later on Sunday on $5,000 bail.

Roger Avary “Pulp Fiction” Screenwriter Sentenced To One Year in Jail For Fatal DUI Crash

In a Ventura courtroom “Pulp Fiction” screenwriter is sentenced to one year in jail and five years probation for a fatal drunk driving accident in that occurred 2008.

Roger Avary, who received an Oscar for writing “Pulp Fiction” with Quentin Tarentino, pleaded guilty to gross vehicular manslaughter and DUI in August after causing a fatal crash while driving while intoxicated in 2008 that took the life of a passenger in the vehicle.

The DUI screenwriter was exceeding speeds of 100 miles per hour when he crashed his Mercedes Benz into a telephone pole in Ojai. His wife Gretchen, was ejected from the car suffering serious injuries. Andreas Zini, 34, another passenger in the vehicle was killed in the fatal DUI crash. He was on his honeymoon with his wife visiting the Avary’s from Italy.

Avary who also co-wrote the screenplay for the movie “Beowulf” was sentenced to one year in jail and received 5 years probation for the January 13, 2008 fatal DUI crash.

Mel Gibson To Have DUI Expunged From Police Record

Actor Mel Gibson is hoping to have his defense lawyer remove his drunken driving arrest from his police record, after completing all the terms of his 3 year probation.

The “Braveheart” star’s DUI defense lawyer, Blair Berk will be in court in October in an attempt to expunge Gibson’s 2006 DUI from his record. The actor who had his license suspended for ninety days has completed an 11 month 12 step alcohol program and a course in alcohol abuse.

Gibson was arrested on July 28, 2006 on suspicion of driving while intoxicated or DUI, after being stopped by police for speeding on Pacific Coast Highway in Malibu. The Academy Award winning actor was driving his Lexus LS 430 about 87 mph in a 45 mph zone.

Breathalyzer test showed that Gibson’s blood alcohol level to be at 0.12 which is well above California’s 0.8 legal limit. Police also found an open container of Tequila in his vehicle, according to Los Angeles County Sheriff’s Deputies.

“Point Break” Actress Lori Petty Pleads No Contest in DUI Case

In Los Angeles Actress Lori Petty who appeared in “Point Break” pleaded no contest through her criminal defense attorney to a DUI charge, is sentenced to five years probation.

The 45 year-old actress who also appeared in the movies “Tank Girl” and “A League of Their Own,” was arrested by police on May 30 in Venice Beach after hitting a skateboarder with her vehicle.

In a written statement, the actress who is accused of drunk driving said “I sincerely apologize for driving after drinking alcohol.” She vowed she would never drink and drive again. “I assure you, this first misdemeanor DUI will be my last,” she said.

Petty has already completed counseling in alcohol abuse which is part of her sentencing, according to City Attorney spokesman Frank Mateljan.

Actor Jeffrey Donovan Arrested for Drunk Driving in Miami Beach

Actor Jeffrey Donovan was arrested for drunken driving in Miami Beach after almost hitting a stopped police car, according to Florida police.

The 41 year-old actor who stars in the USA Network series “Burn Notice” was arrested by Florida police for driving under the influence after he failed a field sobriety test on July 12.

The suspected drunk driver told the arresting officer “Sorry I didn’t see the red light or your stopped car.” He also said, “I really think I’m only borderline and not too drunk. I had three drinks at the Fontainebleau. The only mistake I made tonight was drinking Benadryl with three glasses of wine.”

Before the incident occurred the officer heard a loud screeching noise and saw that Donovan had swerved his car to avoid slamming into his police car.

Chula Vista Cross Country Cyclist Killed by a Drunk Driver

A Chula Vista cyclist who was traveling across the country to protest the government bailouts was killed by a DUI hit and run driver, charges have now been filed against him.

Chula Vista resident Jim Gafney, 65, was on his “Mad As Hell Bike Ride Across U.S.” when he was struck and killed by a drunken driver about 12:40 a.m. on State Route 50, according to Illinois State Police.

Charges were filed for Leon K. Marcum, 27, the DUI driver who left the scene of the accident was first cited for misdemeanor driving under the influence and failure to reduce speed to avoid an accident but after review those charges were dropped. Now he is being charged with aggravated leaving the scene of an accident involving death.

According to Attorney John Hudspeth prosecuting attorney’s may file felony DUI charges. Marcum’s blood alcohol level is also being reviewed.

“We are doing everything we can to make sure we prosecute this case appropriately given the end result-that a man lost his life,” Said Hudspeth.

Marcum’s bail is set at 100,000.

DUI Not Guilty Plea For Wide Receiver Donte Stallworth

Not Guilty Plea to charges of DUI manslaughter for Donte Stallworth, wide receiver for the Cleveland Browns.

DUI defense lawyer Christopher Lyons entered a not guilty plea at a court hearing on Thursday on behalf of Stallworth. Stallworth, 28, who is out on $200,000 bail must not consume alcohol, drive, and is required to abide by a 12:00a.m.to 6:00 a.m. curfew, stated in court documents.

Stallworth was driving under the influence of alcohol on March 14 when he hit pedestrian Mario Reyes, 59, and killing him in Miami Beach. According to Stallworth’s blood test results, his blood alcohol level was .126. Stallworth was allegedly driving drunk at about 50 mph in a 40 mph zone.

If convicted of the DUI manslaughter charge Stallworth would be facing a maximum sentence of 15 years in prison. A date for trial has not been set.

Friend of Former San Diego Chargers Linebacker Foley Found Guilty of DUI

The assault and drunken driving conviction of a woman and friend of Steve Foley, the former San Diego Chargers Linebacker, was upheld last Friday by a state appeals court.

Lisa Maree Gaut , who was with Foley on September 3, 2006 when he was shot in the knee by an off duty Coronado police officer, was found guilty of assault with a deadly weapon and two counts of driving under the influence.

The night the incident occurred, Officer Aaron Mansker followed Foley’s car to his home in Poway. Gaut got into the driver’s seat and tried to run Mansker down, but he was able to get out of the way.

Judge Charles Rogers sentenced Gaut to six months in jail or work furlough in June of 2007.

Foley pleaded guilty to two misdemeanor DUI charges. He had a .21 percent blood alcohol level.

NFL Hall of Famer Arrested for Drunk Driving

A former NFL player and Hall of Famer has been arrested for drunk driving after he was pulled over for speeding, according to Virginia Beach police.

Bruce Smith, 45, was taken into custody and released a short time later on bail is being charged with DUI, refusing to take a breathalyzer test, and speeding, said police spokesman Jimmy Barnes.

The former football great played for the Buffalo Bills and the Washington Redskins. He played in 11 pro bowls. Earlier this year Smith was elected into the Pro Football Hall of Fame.

Smith has 2 prior arrests for driving under the influence. In 1997 his DUI charge was dismissed and in 2003 he was acquitted.

Kiefer Sutherland May Have Violated DUI Probation

Kiefer Sutherland may have violated probation because of run in with a fashion designer .

Jack McCollough, a New York fashion designer has accused Sutherland of head-butting him at a party. Witnesses reported that McCollough knocked actress Brooke Shields to the floor at an after-party for the Met Costume Institute Gala, and that Sutherland demanded for McCollough to apologize to her. McCollough pushed the actor, that’s when Sutherland retaliated with a head-butt.

Sutherland will voluntary surrender to authorities to a third-degree assault, although no charges have been filed yet.

Sutherland is in the process of serving five years probation for a drunk driving charge in 2007. “The terms and conditions of DUI probations include the standard, obey all laws,” said Frank Mateljan, a spokesman for the Los Angeles City Attorney’s Office.

Lane Garrison Incarcerated for DUI Being Released Early

Former “Prison Break” actor Lane Garrison is scheduled to be released from prison early because of credits earned while incarcerated for driving under the influence.

Garrison who is now 28 pleaded guilty to vehicular manslaughter, felony DUI with bodily injury and one misdemeanor count of providing alcohol to a minor, in a 2006 DUI crash that killed a 17-year-old boy and injured two 15 year-old teenagers.

The drunk driver was sentenced to 40 months in prison. According to a California Department of Corrections and Rehabilitation rep Terry Thornton, “We can confirm that he is going to be released to parole soon, but it is our policy not to disclose the inmate’s scheduled date for release date for security and safety reasons.

“He was sentenced to three years and four months, but inmates including Mr. Garrison, can earn credits that reduce the time they spend in prison. He received half time-meaning that for every day that he participated in a rehabilitative program, he got a day off his sentence,” said Thornton.

Suspected DUI Driver Kills Angels Pitcher Ardenhart in Crash

A suspected drunk driver is responsible for killing Los Angeles pitcher Nick Ardenhart and two others on Thursday after a hit and run car accident in Fullerton.

Nick Ardenhart, 22 just finished pitching his season debut for the Angels against the Oakland Athletics throwing six scoreless innings.

At 12:30 a.m. a man suspected of driving under the influence in a red minivan, ran a red light and broadsided a silver Mitsubishi Eclipse that Ardenhart was a passenger in. The DUI driver fled the crash site on foot.

Andrew Thomas Gallo, 22, of Riverside, was captured and identified by police about 30 minutes later. Gallo was driving on a suspended license for a previous drunk driving conviction.

Gallo’s blood alcohol level was “substantially over the legal limit” of .08 percent, said Lt. Kevin Hamilton.

Ardenhart was taken to the University of California, Irvine Medical Center where he died in surgery. The driver of the car Courtney Frances Stewart, 20, and Henry Nigel Pearson, another passenger in the car were pronounced dead at the scene. Jon Wilhite, 24, a forth passenger in the car was in critical condition and expected to live.

Gallo is likely to be convicted of three counts of murder, three counts of vehicular manslaughter, felony hit and run and driving under the influence.

DUI Arrest for Clippers Zack Randolph on San Diego 405 Freeway

Police arrest a Los Angeles Clippers player for suspected drunk driving on the southbound San Diego 405 Freeway early Monday morning.

Zack Randolph, 27, who plays for the Los Angeles Clippers was stopped by the California Highway Patrol in a white Roll Royce around 2:25am this morning because of suspected driving while intoxicated and weaving in and out of lanes.

In a statement issued by the CHP, Randolph was said to be driving “at approximately 60 miles per hour and weaving in and out of the No. 4 lane.” “Upon contacting Randolph, the officers noticed an odor of an alcoholic beverage emitting from within the vehicle,” the statement continued. Officers determined that Randolph was “under the influence of alcohol,” according to the statement.

The suspected drunk driver was taken into custody for DUI. Randolph was released on $5000 bail about 9:00am this morning. He is scheduled to appear in court on April 27th.

San Diego TV Sports Director Arrested on Suspected DUI

A TV sports personality was taken into custody on suspicion of driving under the influence of alcohol after he almost struck a police officer on Saturday night, according to San Diego police.

KFMB-Channel 8 sports director, Kyle Kraska, was arrested for DUI near Sabre Springs.

A San Diego police officer was on a juvenile runaway call around 8:20p.m.when he saw a car speeding around the corner at Angelique Street and Avonette Court. The officer had to flash his lights and had to move out of the way to avoid getting hit by the vehicle.

The suspected drunk driver was in a 2003 Silver Mercedes, when he supposedly accelerated and pulled into the driveway of his home. The officer proceeded to follow him and arrested him.

Kraska was taken into custody and released on his promise to appear.

DUI Sentence For Charles Barkley Only 3 Days

Originally sentenced to serve 10 days in jail, Charles Barkley, Former Basketball Star will serve only 3 days of custody for DUI.

After reviewing Barkley’s case a judge decided he would reduce his time served by seven days if he would agree to enroll and complete an alcohol treatment program.

Barkley, who is 45 years old, was arrested on December 31 for failing a field sobriety test for drunk driving not too long after leaving a Scottsdale nightclub.

According to the Maricopa County Sheriffs Office the former NBA star will be reporting to jail on Saturday morning.

San Diego DUI Crashes Involving Female Drivers on the Rise

San Diego has seen an increase of alcohol related crashes in young female drivers. Is it because of the rise in young Hollywood starlet DUI arrests recently? A researcher with the Automobile Club of Southern California has noted that there could be a trend here.

Researcher Steven Bloch has done a study which revealed that with the recent arrests of Nicole Ritchie, Paris Hilton, and Lindsey Lohan there has been a substantial increase in young female drivers involved in serious alcohol related crashes.

In San Diego County, Bloch said that the largest increase in fatal and injury crashes were among females driving under the influence of alcohol between the ages of 21-24. There were 110 crashes in 2007, up from 49 in 1998 a 124 percent increase, Bloch said.

Another factor in the rise is because advertisers from the alcohol beverage industry targeting young women through the products it develops and packaging if provides. “Walking through the supermarket, I saw one drink that was packaged to look like a perfume bottle.” said Bloch.

According to federal statistics, men are twice as likely as women to be involved in fatal crashes. The majority of fatal substance related crashes are from men with blood alcohol levels of 0.08 or higher.

“A lot of folks don’t realize they’re impaired when they get behind the wheel,” said Teri Kern’s operations director for Occupational Health Services in San Marcos. “There’s still a stereotype that people have to be “drunk” to get a DUI,” she said.

San Diego Defensive Tackle Jamal Williams Booked on DUI Charges

It happened again. The San Diego Chargers had another player arrested for DUI. This is the second time in a month. Jamal Williams the San Diego Chargers Defensive Tackle was arrested on suspected driving under the influence early last Sunday while driving on SR-94. He was pulled over for speeding.

According to the California State Highway Patrol, Williams gave a blood sample to test his blood-alcohol level. The San Diego Defensive Tackle was then taken into custody and later released. The results of his blood alcohol level have not yet been determined.

The San Diego Chargers general manager A.J. Smith said “It’s disappointing to hear about the issue involving Jamal Williams.” “We’ll continue to monitor the situation and let the legal process run its course,” in a statement through the team.

Smith also stated that “The Chargers have always been leaders and positive contributors to our community.” “We take our stature in the community very seriously. Through the Chargers and the NFL, our players help them deal with issues that affect all segments of society.”

Jamal Williams, who has been with the Chargers for 11 years was awarded this season the team’s Most Valuable Player Award that he shared with quarterback Phillip Rivers.

Interestingly, the Chargers were the first team in the NFL to implement Safe Ride Solutions. This is a program where intoxicated pro-athletes can call an off duty police officer for a ride home.

The Chargers were awarded the NFL’s Winston Shell Award for demonstrating dedication and commitment to developing innovative ideas and solutions for implementing this program.

San Diego Wide Receiver Vincent Jackson Jailed and Released on Suspicion of DUI

San Diego Chargers wide receiver Vincent Jackson was taken into custody and released on suspected DUI charges after failing several field sobriety tests. Jackson who is on probation for a previous DUI arrest said in a brief statement released through the team spokesman that he didn’t think charges would be filed against him. However, one of the conditions of his probation is not to drive with a “measurable blood alcohol level”. Another condition of his probation is to “submit to a chemical test if requested by law enforcement”. Failure to do so could result in his driving privilege being suspended for two years. So, even if he is under the legal limit of .08 percent he could still be facing the loss of his driving privilege and some additional jail time.

Jackson was pulled over on Tuesday, January 6th shortly after 2 am on San Diego’s State Route 52 after appearing to be speeding, braking abruptly and weaving in his 2008 GMC Sierra said California Highway Patrol Officer Brad Baehr.

The San Diego Chargers wide receiver, who could be charged with misdemeanor DUI as well as probation violations, is looking forward to clearing his name and proving his innocence in the event that charges are filed against him.

This isn’t the first time the Chargers have had encounters with the law. In 2006 Steve Foley, linebacker for the Chargers was shot three times by an off duty Coronado police officer after an altercation in which Foley was arrested for driving under the influence and having a blood- alcohol level nearly three times California’s legal limit.

Former Fresno State Football Player Jason Shirley Found Guilty of DUI In Second Trial

In a trial that belonged in television, Jason Shirley was found guilty of DUI in his second go-round with the state of California.

In October 2007, Shirley was arrested after driving his car into an apartment building in Fresno, California, and then leaving the scene. He was chased down and then failed a breathalyzer test. Just a few short months later, the Cincinnati Bengals drafted Shirley, although he has yet to play in a single game.

In Shirley’s first trial, Fresno State coach Pat Hill testified that Shirley suffered a concussion during a recent game against Nevada. The defense argued the concussion was to blame for Shirley’s bad decisions that day. And they argued that the breathalyzer failed when it reported Shirley was driving under the influence. The case ended in a mistrial.

In the second trial, Shirley took the stand and admitted he drank a 40 oz bottle of beer before driving into the apartment building. He also testified that he thought he ran over a curb and not into the building. After three hours of deliberation, the jury found Shirley guilty on charges of DUI and hit-and-run. He was sentenced to 30 days in a work program.

The Bengals released a statement about Shirley:

"The club is aware that the vehicular charges against Jason Shirley, stemming from his college career, have been resolved against him," the Bengals said in the statement. "He will likely complete the legal obligations required by the court during the offseason, and the club expects that he will do what he needs to do to put this incident behind him and contribute to the football team."

California Actress Heather Locklear Charged With DUI for Prescription Drugs

California actress Heather Locklear has been formally charged with DUI, reports the Santa Barbara, California District Attorney’s Office. Not alcohol. Not illegal drugs.

Prescription drugs.

Senior Deputy District Attorney Lee Carter refused to comment about the medications or amounts Locklear took, but noted, “Lab tests showed she had no alcohol in her system and no illegal narcotics of any kind. We believe that the prescriptions she was taking could have impaired her ability to drive a motor vehicle safely."

In July 2008, Locklear was treated for anxiety and depression, and many believe the prescription drugs in her system at the time of the DUI may be related.

On September 27, 2008, California Highway Patrol said the actress showed “obvious impairment” when an officer saw her car parked on a highway and blocking a lane in Montecito, but alcohol was ruled out almost immediately. She was tested for drugs on suspicion of DUI at a police station and quickly released.

Heather’s arraignment is scheduled for January 26, 2009 in a Santa Barbara court.

DUI for Pomona, California’s Mayor-Elect Dropped After Blood Alcohol Test Analysis

Pomona City Councilman Elliott Rothman was arrested for driving under the influence of alcohol after failing a field sobriety test at about 11:03 p.m. Tuesday October 7, 2008, and was booked for a misdemeanor about 20 minutes later. Early reports indicated that his blood alcohol level was higher than the legal limit in California (0.08), however further analysis of his test showed his blood alcohol level at 0.04, half the legal amount allowed. Charges have been dropped.

Rothman has served on the Pomona City Council for 12 years, according to the city's Web site, and was recently elected Pomona mayor in the November 4, 2008 elections.

Rothman said he was pleased to hear the news about the last of the tests.

"That's great news," he said.

Rothman said he could not explain why he did not pass the field sobriety test.

"I really don't know," he said.

Third DUI for Former Chargers Player

Lionel James, a former San Diego Chargers player and now a member of the Alabama Sports Hall of Fame, was charged with driving under the influence last month after being pulled over by a Shelby County Sheriff's deputy on an Alabama interstate.

The DUI charge filed against James comes two weeks after the former NFL player pleaded guilty to a separate driving under the influence charge on that same interstate.

In this most recent case, James was stopped by a deputy at 12:43 a.m. James had a blood alcohol level of 0.12, court records state. Alabama and California’s legal limit is 0.08.

James was charged with improper lane usage as well as the DUI. He was held on a $1,300 bond and then released.

On October 9, 2008, James pleaded guilty to the first DUI and misdemeanor theft of property. According to court records, James was given a 175-day suspended jail sentence, fined $250 and ordered to attend DUI school. He also received a 60-day suspended sentence and two years of probation on the theft charge.

That DUI stemmed from a July 24 arrest in which a deputy pulled James over on the same freeway. Just prior to James being pulled over, police received a call about stolen alcohol at a gas station. The vehicle and clothing description matched James, the police report said. Three bottles of alcohol were found in James' vehicle once police pulled him over.

James played in the NFL for the San Diego Chargers, where he set records for all-purpose yards. He was inducted into the Alabama Sports Hall of Fame in 2006.

Former NFL Star Michael Vick’s Bro Guilty of DUI

Former Virginia Tech quarterback Marcus Vick has agreed to a DUI plea deal in order to stay out of jail. In exchange for Vick’s guilty plea to drunk driving, the Norfolk, Virginia court agreed to suspend his jail sentence of 12 months and fine him $530.

Vick will also lose his license for a year. Marcus is the brother of former Atlanta Falcons quarterback Michael Vick. Under California law, pleading guilty can also help you avoid jail time, however, you should contact an experienced criminal defense lawyer to help you with your case.

Marcus Vick was charged with driving under the influence and other related traffic offenses after fleeing from a bicycle officer on June 16, 2008 in downtown Norfolk. Vick, 24, of Suffolk, the brother of suspended Atlanta Falcons quarterback Michael Vick, had previously played for Virginia Tech. He was let go by Virginia’s team in 2006 after a series of problems both on and off the field and elsewhere. Subsequently, Marcus was released by the Miami Dolphins in 2007.

Police reports from the incident in June 2008 say a bicycle officer approached a couple arguing in a car around 2 a.m. When the officer asked for the man's identification, the car took off at high speed. A few minutes later, another officer spotted the car and stopped it. Subsequently, Vick failed a sobriety test, and was charged with DUI, misdemeanor eluding police, reckless driving and driving on a suspended license. In California, driving under the influence is subject to some of the toughest DUI laws in the country and exacerbating a DUI charge by traffic violations will only increase your chances of more serious punishment.

Vick was arrested and taken to the sheriff's department for booking. He was released later on $1,000 bond.

Former San Diego State Player Matthew McCoy Loses His Job After Felony DUI

Matthew McCoy, a former reserve linebacker for the Tampa Bay Buccaneers and San Diego State, was arrested October 18 and charged with felony DUI. Police say McCoy was stopped less than 300 feet from his home in Tampa, Florida.

McCoy reportedly refused a breathalyzer test and was subsequently arrested. In California, drivers who refuse the chemical test can be sentenced to jail terms if they've previously been convicted of DUI.

The San Diego Chargers will travel to Tampa Bay in December to play a game against a Buccaneers team that no longer includes McCoy. The Bucs released McCoy from their roster around 4 p.m., less than 12 hours after his arrest.

McCoy, 26, was pulled over about 4 a.m. after police saw him driving the wrong way down a busy boulevard. McCoy smelled strongly of alcohol, had bloodshot and glassy eyes, and swayed while standing still, according to the police report. He refused a blood alcohol test on advice from his lawyer and was arrested. He was released on $500 bail Saturday afternoon only to learn he had been cut from the team.

McCoy, a star at San Diego State, was in his fourth NFL season. He was a second-round pick for the Eagles in 2005 and started ten games in 2006. The Bucs signed McCoy to a free-agent contract in March of this year and he had appeared in three games at middle linebacker.

His next court date is not known.

DUI Arrest for Professional Baseball's Newest Star, Joba Chamberlain

New York Yankees up and coming star pitcher Joba Chamberlain was arrested October 18 for DUI in Lancaster County, Nebraska after police pulled him over for speeding. Police reports place his blood alcohol level at 0.13, which is higher than the legal limit of 0.08 in Nebraska and California.

Chamberlain, 23, was arrested early Saturday after Nebraska state police pulled him over for speeding and then noticed an odor of alcohol in the 2006 BMW 750I. They then saw the open container of alcohol. California law stipulates that it is illegal to drive with an open container of alcohol in the vehicle. If apprehended, drivers can face license suspension and jail time, however, with a previous DUI, charges may be more serious.

Chamberlain was taken to a policy facility and released. Chamberlain will appear in court on December 17.

New York’s rising star pitcher Chamberlain issued an apology to the Yankees and their fans, reported Newsday.

Since his major league debut in August 2007, Chamberlain has become one of the Yankees' most popular players. He has had tremendous success on the field, and his outgoing personality attracts fans. The Yankees have plans to place Chamberlain in their pitching lineup for the 2009 season.

Santa Monica, California Lawsuit Filed Against Lindsay Lohan For 2007 DUI

Actress Lindsay Lohan is the subject of a lawsuit filed by three men in a Santa Monica, California Superior Court who were passengers in her vehicle when she was stopped and arrested for her second DUI in 2007.

The lawsuit was filed by Ronnie Blake, Jason Sutter, and Dante Nigro, and the trio are seeking unspecified damages. They claim that Lohan was angry and aggressive in her driving, causing them to feel "shock, fear, and panic at [her] surprising and sudden act" of allegedly commandeering the car to chase her personal assistant through the streets of Santa Monica. They also allege that Lohan was intoxicated and "hostile" and "endangered" the mens' lives during the "joyride." She allegedly told them, "She was a celebrity ... she could do whatever she wants."

Ed McPherson, Lohan's attorney, has called the lawsuit "absurd" and told TMZ.com, “These guys had the night of their lives.”

Lohan spent 84 minutes in jail for her second DUI.

Retrial for NFL's Darion Conner in DUI Manslaughter Case

Darion Conner will get a retrial. Thus ruled a judge 3 years after Conner was originally sentenced to 15 years for DUI manslaughter and vehicular homicide charges stemming from a 2004 accident. An appeals court ruled that Conner should be retried because a judge improperly showed a photograph of the victim to the jury.

Conner's blood alcohol level at the time of the crash was 0.27, more than three times the legal level. In California, the legal limit is 0.08.

And, during the trial, a toxicologist said Conner likely consumed 16 to 21 drinks before he got behind the wheel and subsequently hit and killed bicyclist Jonathan Michael Conklin in September 2004.

The accident was Conner's seventh arrest and fifth conviction for DUI. At the first trial, the judge revoked Conner’s driving privileges for life.

Barring Video Evidence, NFL Player’s Hearing is Postponed

Titans defensive end Jevon Kearse is off the hook until January 6, 2009. Kearse was pulled over and charged with DUI on June 22, 2008 after Vanderbuilt University police spotted his sports utility vehicle weaving across a road. Kearse refused a breath test at the scene. Kearse’s attorney has told the judge that neither he nor the prosecutor have been able to see the police video of Kearse’s arrest. Results from a blood alcohol test are not known. California’s blood alcohol limit is 0.08.

Police say Kearse was speeding and swerving in his sport utility vehicle and when pulled over, Kearse had slurred speech, red eyes and alcohol on his breath. He claimed he had only had a Vodka and Red Bull and then refused the breath test. In California, drivers who refuse the chemical test can be sentenced to jail terms if they've previously been convicted of DUI.

Kearse re-signed in March with the Tennessee Titans, where he was the NFL's defensive rookie of the year in 1999, after playing for the Philadelphia Eagles previously. He has struggled with injuries and ineffectiveness in recent seasons and is expected to be a situational pass rusher this season.

Former California College Football Star Jason Shirley and His Hit-and-Run DUI Case

Former Fresno State football player and current Cincinnati Bengals rookie Jason Shirley showed up back in court last week after a judge threatened to issue a warrant for his arrest. Shirley faces DUI and hit and run charges from a DUI arrest in October 2007. Shirley is accused of driving drunk and crashing into a Fresno, California apartment. Shirley left the scene of the crime before officers arrived.

Shirley’s hectic professional football schedule was the reason for the judge to threaten a warrant, but on September 30, with Shirley in attendance in court in Fresno, California, Judge Brant K. Bramer set dates for Shirley’s retrial.

Shirley’s lawyer, Charles Magill, insists, “This case comes at a great cost professionally, they know it, and that’s why they’re trying to force him back into trial.” Magill added, “A rookie player who misses seasonal games is gonna have an impact on them,” speaking of Shirley’s new employers, the Cincinnati Bengals.

Magill has already publicly stated that he plans to ask the judge to drop the charges. Magill also has plans to call the Fresno State football team doctor to the witness stand to discuss whether or not Shirley’s concussion from a previous football game may have had any bearing on the accident.

Shirley’s hit-and-run DUI retrial begins October 29. A jury motion is scheduled for October 14. This is Shirley’s second trial for this incident; a mistrial was declared in June at Shirley’s first trial, after the jury was deadlocked.

Another NFL DUI: Brandon Marshall Finally In Court Almost A Year Later

NFL Denver Broncos wide receiver Brandon Marshall pleaded guilty on Friday, September 12, 2008 to a reduced DUI charge as part of a plea deal. Marshall pleaded guilty to driving while ability-impaired, not driving under the influence as was previously reported, and was sentenced to one year of probation. He was arrested in the fall of 2007 for driving under the influence and for driving the wrong way on a one-way street and failing to drive in a single lane. Marshall was arrested in downtown Denver early in the morning of October 22, hours after the Broncos beat the Pittsburgh Steelers 31-28 in Denver. In California, driving under the influence as well as other offense can lead to stiffer penalties.

The city's attorney's office agreed to drop a separate pending traffic case from June 2008 as part of the plea deal. The judge also agreed to drop the charges of driving the wrong direction and wandering out of his lane. Marshall will pay $1,100 in fines, will serve 24 hours of community service, and will attend alcohol education classes and will serve on a victim-impact panel. Maybe Marshall should get some glasses? Or was it another ability that was impaired? Inquiring minds would like to know why this NFL player got a reduced plea. In California, Marshall would more than likely have faced much more penalty as a result of his wrong-way, DUI, driving experience.

Twin NFL Player DUIs: First Up, Lawyer Milloy's Driving Under the Influence Arrest

NFL Atlanta Falcons safety Lawyer Milloy was arrested for DUI and speeding in Atlanta in the early hours of Monday, September 15, 2008. The former Super Bowl champion, 34, posted a $1,640 bond and was later released from a Gwinnett County, Georgia jail around 9:40 a.m. later that same morning.

Authorities reported that Milloy was speeding on an interstate in Georgia when he was pulled over and found to be driving drunk.

Atlanta Falcons head coach Mike Smith stated he considered Milloy a great player and that the matter would be handled internally. Smith and Milloy met on Monday, but neither discussed what happened during that meeting.

DUI For Hip Hop Artist Webbie After High-Speed Chase

Hip-hop star Lil Webbie was arrested on multiple charges, including DUI after a high-speed chase with police on an interstate in Mississippi. A police officer had attempted to pull Gradney over in his 2009 Dodge Challenger for a traffic violation. According to police, Gradney ignored police lights and continued driving recklessly. After speeding along the interstate, the Dodge Challenge exited the freeway and ran into another car, but kept right on going. The Challenger was later found abandoned in a Wal-Mart parking lot. Later, police pulled over another vehicle and found Lil Webbie inside with two other occupants. After the high-speed chase, Webbie was identified as the driver of the damaged Dodge Challenger and taken to Forrest County Regional Jail where he was charged with one count of felony eluding, one misdemeanor count of possession of marijuana, and one count of driving under the influence. His vehicle was seized as evidence. In California, driving in possession of a controlled substance is against the law. Serious penalties may apply to persons apprehended on suspicion of DUI if compounded with other offenses.

Actress Heather Locklear Pulled Over in Santa Barbara, California on Suspected DUI

Heather Locklear was arrested on suspicion of driving under the influence of a controlled substance Saturday evening in Santa Barbara County, California. Alcohol was ruled out, but California Highway Patrol spokesman Tom Marshall states, “[W]e believe Locklear was under the influence of prescription medication.”

Locklear was exiting a parking lot in Montecito around 5 p.m. in the afternoon on Saturday and a witness reported she was driving erratically—revving her engine and running over a pair of sunglasses multiple times.

Soon after, the same witness saw Locklear exiting her vehicle on a nearby highway. The witness than called 911, concerned for Locklear’s safety, even though she did not recognize the actress. When police arrived Locklear was seated inside her vehicle, which partially blocked the roadway.

Just two months ago, Locklear attended an Arizona treatment facility for anxiety and depression. Tests are pending and we will update when those results are reported.

Two Years After her DUI, California Star Nicole Ritchie Has Gone the High Road

New mommy Nicole Ritchie has apparently cleaned up her act. A judge determined this week that the former Simple Life has done a complete turn-around and is “in compliance” with the terms of her probation stemming from her 2006 DUI bust, reports E! News.
Richie, who was caught driving the wrong way on an L.A. freeway after taking Vicodin and smoking pot in 2006 has become a mother (daughter Harlow Winter Kate Madden was born January 11, 2008), started the Richie-Madden Children’s Foundation, and continues to comply with her probation restrictions.
Ritchie was placed on three years' probation in July 2007, served just 82 minutes of a four-day jail sentence last summer while pregnant, and even though only required to clock in for three weeks, Ritchie signed up for an entire 18-month alcohol education program.
A follow-up hearing has been set for February 20, 2009. However, like last week’s hearing, Richie, who instead attended a few shows at New York’s fashion week, will not be required to appear.

California Celebrity Blogger’s DUI Dish Curtailed After his Own Drunk Driving

Hooman Karamian, also known as “Nik Ritchie” on TheDirty.com, a popular celebrity blogger website based in California was arrested for driving under the influence in January 2008.

It is ironic because Ritchie has a wall of shame on which he posts mug shots of celebrities who are busted for DUI and other nefarious acts. The Smoking Gun has released the police report from the night of Karamian’s arrest.

During processing after his arrest, Karamian said that the cop “did not know the things he did for the community, and that a DUI would not be a good thing for him,” the report reads.

Tests showed his blood alcohol count was .165, more than twice Arizona and California’s .08 limit. Karamian pled guilty to a misdemeanor drunk driving charge at the Scottsdale City Court.

His occupation listed as “website writer,” Karamian/Ritchie was the famous celebrity blogger who found pictures of Matt Leinart holding a beer bong for a co-ed. The rest of the story: Kurt Warner is the new starting quarterback for the Cardinals. Not that we blame Ritchie for that, but thanks to the Smoking Gun for exposing this celebrity blogger.

Oakland Raider Popped for DUI in California Hours After Wining Game

Hours after helping the Oakland Raiders win against the Kansas City Chiefs, Raiders defensive tackle Tommy Kelley was arrested in Oakland for drunk driving.

Tommy Kelly was pulled over on Sunday night on suspicion of driving under the influence and was then charged with a DUI. A 300-pound defensive player, Kelly was signed to the Raiders last year just before he was to become a free agent. His contract, the largest ever given to a defensive lineman, is a seven-year $50.5 million contract, which includes $18.125 in guarantees and $25.125 million in the first three years.

AOL's celebrity website TMZ.Com confirmed the arrest and reported that Kelly posted bail and was released from police custody. The Oakland Raiders representative had no comment.

DUI for LOST Star: Dae Kim Pleads No Contest

E! Online almost gleefully reports the ongoing saga of LOST star Daniel Dae Kim, who pled "no contest" to DUI charges last Friday. The popular television show's creators have no qualms about throwing stars off the show as a result of their DUI arrests. Kim is the fourth in a line of LOST stars whose characters were almost immediately eliminated from the show because of their careless driving habits (three other cast members were charged with DUI) while in Hawaii during LOST filming, reports TMZ.com.

Kim was driving erratically in late October 2007 when an officer pulled him over and administered a blood test. According to court documents, Kim’s blood alcohol level was shown to be .0168, which is more than twice the legal limit in Hawaii and California.

Kim’s license has been suspended for six months and he was ordered to perform 72 hours of community service, pay a $500 fine, and $212 in court fees.

Hollywood, California TV Star Pleads Not Guilty to DUI

Television star Scott Michael Foster of Greek pled not guilty last week to DUI charges from his bust earlier this summer in southern California.
Foster was arrested in the early hours of July 21 after he failed a field sobriety test issued during a routine traffic stop. He was charged with drunk driving because his blood alcohol level was 0.08 percent or above. California's legal limit is 0.08.

After several hours, he was released on $5,000 bail and then returned directly to the set of his television show. Yahoo! News reports he apologized to his fellow cast and crew upon his return to the set. A pretrial hearing will be held on September 22.
